Terms of Service

Last updated: September 2026

1. Acceptance of Terms

These terms govern your use of wynnett.com and of any Wynnett service you purchase or receive.

If you purchase a service through a Wynnett order form, you accept these terms when you check the box agreeing to them on that form. The order form sets out the price, billing, and renewal terms for that service, and those terms apply in addition to this page.

If you and Wynnett have signed a master services agreement or a statement of work, that agreement governs the services it covers. These terms apply to those services only to the extent the signed agreement does not address the same subject.

If you use wynnett.com without purchasing a service, these terms and our Privacy Policy govern your use of the site. If you do not agree, please do not use the site.

Where a master services agreement, statement of work, or order form conflicts with these terms, that document controls, solely as to the terms it expressly addresses.

2. Description of Service

Wynnett provides AI-powered revenue operations software and services to B2B companies. Features include automated outbound sequences, lead qualification agents, follow-up automation, and pipeline analytics. Service features may change over time.

Wynnett also offers SignalSifter, a subscription service that monitors publicly available internet sources for activity relevant to a customer's market and generates written content based on what it finds. Content is produced using the brand voice, product information, and positioning the customer provides, and is delivered to the customer for review. Wynnett does not disclose the sources, methods, or criteria used to identify relevant activity, and nothing in these terms obliges it to do so.

3. Use of Service

You agree to use the service only for lawful purposes and in compliance with all applicable anti-spam laws (including CAN-SPAM, CASL, and GDPR marketing provisions). You are responsible for all activity under your account and for maintaining the confidentiality of your credentials.

4. Prohibited Conduct

You must not use the service to send unsolicited bulk communications without a legitimate legal basis, to impersonate any person or entity, to scrape or systematically extract data from our platform, or to attempt to gain unauthorised access to any system or network.

5. Intellectual Property

All content, trademarks, and technology on wynnett.com are the property of Wynnett or its licensors. You receive a limited, non-exclusive licence to use the service during any active subscription. No ownership rights are transferred.

You retain all rights in the material you provide to us, including your brand voice, product information, positioning, and any other content or data you supply. As between you and Wynnett, you own the content the service generates for you, and you may use, modify, publish, and distribute it without restriction by us.

You grant Wynnett a non-exclusive licence to use, store, reproduce, and process the material you provide solely to operate and deliver the service to you. That licence is limited to that purpose, lasts no longer than necessary to provide the service, and confers no other rights in your material.

6. Disclaimer and Limitation of Liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Wynnett shall not be liable for indirect, incidental, or consequential damages arising from your use of the service. Our aggregate liability shall not exceed the fees paid by you in the twelve months preceding the claim.

Content generated by the service is provided without warranty of any kind, including any warranty that it is accurate, complete, current, or free of infringement of the rights of others. Generated content may contain errors or statements that are not correct.

You are responsible for reviewing generated content before using or publishing it, and for deciding whether it is suitable and accurate for your purposes. If you publish or otherwise distribute generated content, you do so as the publisher of that content and you are responsible for it.

7. Fees and Payment

All fees are due in advance and are non-refundable, including any one-time setup or onboarding fees. Cancellation stops future renewals; it does not entitle you to a refund of fees paid for the current or any prior billing period.

8. Termination

Subscriptions run month to month and renew automatically at the start of each billing period unless cancelled. Either party may cancel at any time before the next billing date, and cancellation takes effect at the end of the current paid period. Your access continues through the end of that period.

We may suspend access for non-payment. We also reserve the right to suspend or terminate accounts that violate these terms without notice.

9. Governing Law

These terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-law principles. Disputes shall be resolved through binding arbitration in accordance with JAMS rules, with the arbitration seated in Clark County, Nevada. Any action that may be brought in court shall be brought exclusively in the state or federal courts located in Clark County, Nevada.

10. Changes to Terms

We may modify these terms at any time. We will provide notice of material changes via email or a prominent notice on our site. Except as stated below, continued use after changes take effect constitutes acceptance.

If you have an active subscription, changes to these terms do not apply to you during the period you have already paid for. The terms in effect when that period began continue to govern it. A change takes effect for you at the start of your next billing period following notice, and renewing into that period constitutes acceptance of the change. If you do not agree to a change, you may cancel before your next billing date under Section 8, and your access continues through the end of the current paid period.

11. Waiver and Variation

No delay or failure by us to enforce any provision of these terms operates as a waiver of it. Any waiver of, or variation to, these terms is binding on us only if made in writing by an authorized representative of Wynnett. A written waiver or variation is effective whether made before or after you accept these terms, and applies only to the matter and the occasion it expressly addresses. No oral statement varies these terms.

12. Entire Agreement

These terms, together with any order form, master services agreement, or statement of work that applies to you, are the entire agreement between you and Wynnett on their subject matter, and supersede all prior and contemporaneous discussions, proposals, and representations, whether oral or written. This section does not affect any written waiver or variation made under Section 11, which remains effective according to its terms.
